Is mediation confidential?

Yes. Mediation is intended to be a confidential process and is conducted in accordance with Tennessee Supreme Court Rule 31. Participants agree not to disclose or use communications from the mediation outside the process, and recording is not permitted.

Confidentiality may be limited in certain situations, such as threats of harm, intent to commit or conceal a crime, reports of abuse, or when disclosure is otherwise required by law. The Request for Mediation and any final written agreement are not confidential.
