When can compensatory time be given instead of cash for non-exempt overtime?

Compensatory time may be granted instead of cash if:

  • The appointing authority requests it,
  • The Commissioner of Human Resources approves it, and
  • Sufficient funds are not available to pay cash.

In this situation, an agreement or understanding must be reached with the employees before work is performed, communicated in writing, and documented by the agency.
