Can an employee receive compensation beyond assault pay while waiting for a claim decision?

Yes. If the employee files a claim with the Division of Claims Administration (Division), the appointing authority may compensate the employee for the difference between:

•    the employee’s weekly salary at the time of injury, and
•    the weekly compensation awarded by the Division.

This applies only for the period between the date of injury and the Division’s action date and may not exceed ninety (90) calendar days.

The agency keeps the employee on regular payroll, and the Division reimburses the agency for the period between days 28 and 90. Assault pay may be used intermittently up to the ninety-day limit.

This provision does not apply if the employee fails to file a claim within ten (10) days of the injury.
