Can employees use sick leave during parental leave?

Yes. A state employee may use sick leave for parental leave absences for a period not to exceed the employee’s accumulated sick and annual leave balance, or twelve (12) weeks, whichever is less.

To use sick leave, the employee must provide written notice with a statement from the attending physician indicating the expected date of confinement.

Use of sick leave before and up to twelve (12) weeks after delivery is subject to the ordinary rules for sick leave: the employee must be unable to work or must be caring for a sick or disabled family member.

For adoption, sick leave may be used up to twelve (12) weeks after the employee receives custody of the child.

All sick leave during a parental leave of absence must be coded as Parental Sick Leave (MPSL) in the attendance and leave reporting system.
