Can an employee who is leaving state employment donate their sick leave?

Yes. A separating or terminating employee may donate sick leave if all of the following conditions are met:

  1. The employee has identified a specific recipient to receive the donated leave.
  2. Donated leave must be used before the donor’s last day worked.
  3. The employee must donate at least five (5) days of sick leave (37.5 hours for a 7.5-hour schedule or 40 hours for an 8-hour schedule).
  4. The recipient must be eligible to receive the leave — meaning they have already used all available SLB and other leave — before the donor’s last workday.

Example:
If an employee has 14 working days left before separation, they must donate at least 5 days of sick leave, and the recipient must fully use this donated leave before the donor’s final working day.
