Can my unused sick leave be reinstated if I return to state employment?

Yes. A previously unused sick leave balance can be reinstated if the employee:

  1. Worked continuously for at least one (1) full year,
  2. Left employment in good standing, and
  3. Returns to state service scheduled to work at least 1,600 hours per year and eligible to accrue leave.

The sick leave balance is credited after the agency receives proper documentation from the employee’s previous or current agency.

The one-year requirement does not apply to an employee or local school board worker in Tennessee who leaves in good standing and becomes a full-time state employee within six (6) months. Those employees will receive full credit for their prior sick leave once proper documentation is received.

Sick leave reinstatement is not allowed for employees dismissed for gross misconduct but is allowed for all other reasons for leaving state service.
