To be eligible, in state government an employee must 1) work for the state for 12 months and 2) work 1,250 hours during the 12 consecutive months prior to the start of the leave. An employee may be eligible for leave under the FMLA based on certain qualifying conditions which include 1) birth of a child, 2) adoption and foster care, 3) employee’s serious health condition, 4) family member’s serious health condition, 5) qualifying exigency, and 6) military caregiver leave.
