Can I take PFL if I have already exhausted my FMLA leave for the same qualifying situation? What about if I’ve exhausted my FMLA for a different condition?

If an employee has already exhausted their FMLA leave due to the same family member receiving hospice care, they will not be granted additional leave under Paid Family Leave (PFL) for the same condition. The employee may be able to take additional leave under other attendance and leave policies. If the FMLA leave was exhausted due to an unrelated condition (i.e., the employee’s own serious health condition), the employee will be able to take PFL if otherwise eligible.
