When is military leave granted?

Military leave is granted to uniformed servicemembers who are absent from work to perform military duties—either voluntarily or involuntarily—under competent authority.

Covered circumstances include:

  • Active duty and active duty for training
  • Initial active duty for training
  • Inactive duty training
  • Full-time National Guard duty
  • Exams to determine fitness for military service
  • Funeral honors duty for National Guard or Reserve members
  • Duty by National Disaster Medical System (NDMS) intermittent employees when activated for a public health emergency or approved training (added by Pub. L. 107-188, June 2002) (See Title 42, U.S. Code, Section 300hh-11(d)
  • Activation by the Governor under Tenn. Code Ann. §§ 58-1-106 or 58-1-108
  • Deployment of FEMA Reservists under the Civilian Reservist Emergency Workforce (CREW) Act for disasters, emergencies, or critical training
