Are temporary agency employees entitled to job restoration after FMLA leave?

Yes. If a temporary agency employee takes FMLA leave, they are entitled to return to the same assignment held before the leave—only if the agency is still using temporary services when the employee is ready to return.
If the agency is no longer using temporary services, the employee is not guaranteed restoration to that assignment.
