What job protections apply when an employee returns from FMLA leave?

When an employee returns from FMLA leave, they must be restored to their:
•    Original position, or
•    An equivalent position with the same pay, benefits, duties, and working conditions.
The restored job must have substantially similar responsibilities, authority, and effort.
Employees also return with:
•    Any general pay increases given during their absence,
•    The same shift or work schedule, and
•    A work location near their prior assignment.
