If an employee has no sick, annual, or compensatory leave, their FMLA leave is taken as unpaid leave. However, an employee on FMLA leave who is also eligible for Paid Parental Leave or Paid Family Leave may receive up to six (6) workweeks of paid leave (which does not count against annual, sick, or compensatory leave).
Any FMLA leave beyond the six (6) workweeks must be taken as unpaid if the employee has no accrued leave available.
For more information, visit the State of Tennessee Attendance and Leave Manual.
