Yes. FMLA leave may be used before or after the placement of a child for adoption or foster care.
Leave taken before placement must be related to the placement process, such as:
• Required counseling sessions
• Court appearances
• Legal or medical consultations
FMLA does not require that the adoption come from a licensed agency for eligibility.
Foster care means providing 24-hour care for a child away from their parents or guardian, where the placement is made by or in agreement with the state and involves state action in removing the child from parental custody.
